Failure to move over for a stationary emergency vehicle

MCL 257.320a(1)(o) assesses 2 points for a violation of section 653a(2), a civil infraction carrying a $400 fine. The 4 point figure on older lists is the pre-2019 value that 2018 PA 349 repealed. Sections 653a(3) and 653a(4), where the violation injures or kills someone, carry 6 points under MCL 257.320a(1)(b) and are not civil infractions.

What the points do

A Michigan court that convicts a driver of a moving violation sends an abstract of the conviction to the Secretary of State, and the point value from the schedule in MCL 257.320a attaches to that abstract. Points stay on a record for two years from the date of the conviction. A non-moving violation produces an abstract with no points on it, which is the whole of the difference behind a plea to one.
